Supervisor Showdown: Delgaudio Attempts to Preempt Board Action

After a prosecutor declined to seek indictments against the Sterling supervisor, the Loudoun Board plans disciplinary measures.

In anticipation of a move by fellow members of the Loudoun Board of Supervisors to take disciplinary action this week, Supervisor Eugene Delgaudio has filed requests for injunctions against such measures.

Delgaudio was accused earlier this year of using his county staff to conduct private and campaign work. A grand jury assembled by a special prosecutor issued a report that called on the Virginia General Assembly and Loudoun County to shore up lax laws and policies.

During the board meeting last week, supervisors indicated their intent to take action, which is expected to include stripping Delgaudio of his budget for staff aides, according to the lawsuit. The board had previously removed Delgaudio from his committee assignments. In the suit, Delgaudio states that he expects the board to take action during its meeting Wednesday.

“Please know I do not make this request lightly,” Charles L. King, Delgaudio’s attorney, wrote in a letter to the Loudoun Circuit Court. “I do so reluctantly with the knowledge of the incredible constraints this Court is operating under.”

The lawsuit calls for, at least in part, an injunction against board action until the court “can determine the procedural requirements which are consistent with the Plaintiff’s due process rights under the United States Constitution.”
