York Admits Error, Denies Delgaudio Cover Up

Speakers at town hall meeting critical of Loudoun board chairman’s actions.

After canceling a meeting set to focus on the investigation of Supervisor Eugene Delgaudio (R-Sterling) for work he asked his aides to do, County Chairman Scott K. York (R-At Large) took an earful from residents concerned with his handling of the complaint against Delgaudio.

The primary concern centers on when York received documents related to the complaint and why he did not turn them over to a special prosecutor in the spring. That special prosecutor is examining the complaint once again, this time with the full package of documents Delgaudio’s former aide provided to the county.

York told a gathering at the County Administration Building in Leesburg Tuesday night he had no idea when the investigation would wrap up, but that a similar investigation conducted in the past took about six months.

In the meantime, the Loudoun Board of Supervisors has suspended its investigation of possible violations of board policy.

“I’m not trying to cover this up,” York said early in the meeting, providing a chronological listing of his recollection the investigation.

The error York acknowledges is that he did not turn over document provided to him to the special prosecutor in the spring. The prosecutor said she lacked information to find wrongdoing at that time.

“What I’m trying to wrap my head around is why you wouldn’t turn over all the documents,” said Paul Siker.

“This is where I need to apologize to everybody in the public,” York said, adding that, “my simple mind simply thought” the prosecutor would talk to the aide and obtain the same documents before making a determination. “But that clearly didn’t happen. I respect the fact that many of you don’t like how I’ve handled this.”

One speaker said they found it “incredulous” that York would not turn the documents over right from the start.

In September, York said, he reviewed the documents again “and found something I simply did not see previously.” He would not describe it, but said it raised concerns and involved “conduct of such a nature that was not inside the office, but outside the office.”

Local activist Phyllis Randall wondered why York held the town hall meeting on a holiday week when families are busy preparing to head out on the busiest travel day of the year.

Several residents wondered why Delgaudio had not been stripped of his committee duties; he participated in the Finance/Government Services and Operations Committee meeting earlier in the day when new policies for aides were discussed.

York is a Republican turned Independent turned Republican again. He rejoined the party last year when he ran for reelection, which put him in the position of endorsing Delgaudio, with whom he often butted heads. One speaker asked if York regretted that endorsement.

“I regret a lot of things in life,” York said. “I’ll leave it at that.”

Debbie Piland, who ran for school board last year, told York, “I think it takes guts to come out here tonight,” but continued to press him about the timeline of what he knew and what actions he took.

At times, speakers quizzed York interrogation-style, as if trying to catch discrepancies in his story.

And Delgaudio’s investigation was not the only subject. Residents also peppered York with questions about the Loudoun Hounds ballpark move to One Loudoun and the placement of HS-8, the next Ashburn high school, in Lansdowne.

York also said he was trying to follow the advice of the county attorney by not jumping the gun on Delgaudio.

“Most board members have received a call from me to remove the operational funding from his office,” York said, but he was advised against such a move.

The board’s finance committee has proposed new changes that would restrict supervisors’ aides from working privately or on a campaign for their supervisor.

Supervisor Eugene Delgaudio has brought continuing shame and ridicule upon the residents of Loudoun County for years. He has used his position to encourage discrimination against minorities, fanned the flames of mistrust of immigrants, and during his tenure has regularly and publicly directed hate speech toward the GLBT community. During a Board of Supervisors meeting, he used the pronoun "it" to refer to a transgendered person. Yet this Board has done nothing, claiming the lack of authority to do so. Each of the eight other Supervisors has looked the other way while Delgaudio continued his hatemongering. Is this because all the other Board members are also Republican? As is often the case in political wrong doing in government going back as far as the Nixon Administration, it is now coming to light that there was also a coverup by the Board Chairman, Scott York. He deliberately withheld evidence during the initial inquiry into the matter of Delgaudio's malfeasance by the Loudoun County Commonwealth attorney office. The result was a finding of no merit and the matter was not pursued. York has done nothing to dispel his apparent nonfeasance as the Board's chair. If it walks like a duck and quacks like a duck, maybe this is really a coverup! Eugene Delgaudio does not conduct himself in his Supervisor's post with even a minimum of ethical discretion. Should there be legal consequences found by the special investigator, he should resign immediately from his post.

Like it or not, Supervisor Eugene Delgaudio was duly elected and sworn in, multiple times. I am not defending Delguadio, not at all. Personally I find his rhetoric and conduct to be indefensible. The questions you raised have merit. But I can't help but ask why didn't the previous Board (who had a majority of Dems on it), do anything to address Delgaudio's behavior? They had numerous opportunities to call for an investigation, censure him, remove or block him from various committees, re-write the aides policy, request the VA-GA to create new laws, etc. They did absolutely nothing. Delguadio wasn't the only Supervisor who had "aide" problems or was known to be abusive towards aides. The investigation evolved, as more evidence was uncovered. The (criminal) investigation is ongoing, nothing has been reported or deemed conclusive. However, the LCDC and their surrogates, like the Real Advocate PAC are publicly slinging their "opinions" (not facts) of what they deem as criminal or illegal actions. The PAC has publicly called Delgaudio, a liar, cheat, fraud, criminal, immoral. The PAC's ED called the Chairman of the County a coward. Ironically Delgaudio's enemies, like the Millers & Wientraubs are actually turning Delguadio in to the victim.

The liberals are just out to get anyone who does not go along with their agenda.I agree with Myth Buster when the Dem. were in charge if they had a problem with Mr.Delgaudio why didn't they do something then.You think maybe as the saying goes it is just SOUR GRAPES.

Ain't that the truth. Don't forget calling our attorney part of the "cover-up". Delgaudio is becoming a martyr for all the wrong reasons but the LCDC continues to bash and make unsubstantiated claims as Eugene would say hyperbole!

When there is a credible and documented accusation of financial fraud over the use of taxpayers money, I don't think that constitutes a partisan issue. There are more than just democrats that are upset at what Delgaudio does. And if you are not upset at the actions of Delgaudio, then you are nothing but a party hack trying to defend the indefensible. Or you're just like him.

What credible and documented accusation? The one our attorney is looking at? If charges are brought by the attorney then you have reason to suspend Delgaudios work on the board until then it is just your biased perception we are not going to rely on. I have no party affilation nor do I care which one Eugene belongs to and neither should you. As long as i am not like you and make wild assumptions then i have no problem with my self worth.

The LCDC can speak for itself. None of the officers of the Real Advocate PAC are members or participants in that organization's response to Mr. Delgaudio and the investigation into his conduct. Anything the Real Advocate PAC has said about Mr. Delgaudio's conduct is documented with evidence obtained via the Freedom of Information Act. Anyone can go to our blog and see that for themselves: http://www.realadvocate.org/blog0/blog/ . Or, if you prefer to engage in fact-free speculation, you can go ahead and continue doing that. Most members of the previous board did, in fact, stand up to Eugene for his hateful behavior toward citizens. That showed the kind of leadership that is sorely lacking on this board, which is now additionally faced with evidence of his misuse of office. I do agree that the previous board should have realized there were problems with the aide policy, even though the problems at the time didn't involve improper fundraising and campaigning. Thank you for letting us know that Eugene's defenders think we're making him into a martyr by publishing documentation of his behavior. That is useful information.

He forbid her to answer the phone or to help constituents. She details what a SOB Delgaudio is to all his female aides–and the contempt and scorn he has for everyone, most of all, voters. In Donna's own words: "He then said that I was 'too nice…to [sic] nice to the other Aides, office workers, and most of all, the constituents. I would never know how to treat them. I would never know how to tell them to go away. To hang up on them.' "Monday, he fired me. "I thought the supervisors were elected to represent the people and the area they lived in. Eugene told me he didn't have time for any of that. He also said that 'he didn't need that office.' I thought that was really strange." "Robin, Chairman York's Senior Aide told me that she did all of Eugene's constituent work because if it was sent to him or his office, nothing got done. She said she even mentioned to him that he needs to pay her for all the work she does for the Supervisor of Sterling."

@ Satchmo I will look at Donna's statement again because i must have passed over the part where York's aide was doing his constituent work do forgive me. I guess you run into a lot of uppity people don't you. To be sure I am fair and balanced I have the liberal lefty loons from the democrat party kiss the left cheek and the right wing nut jobs from the republican side get to kiss the right side. I see regurgitated talking points but show me a law that was broken then you'll get some support. Being a tyrant and a dodo isn't good enough I need proof that the CA will charge Eugene with something other than a nuisance misdemeanor.

The paperwork that CA Stamos is supposed to be reviewing is still sitting in Plowman's or Roberts office because for some strange reason the police have not delivered it to the CA. If they will not do it hire a courier. This case should be drawing to a close instead she has only seen the 8 page report? C'mon man! Collusion, inept or just stupid e-mail CA Stamos at tstamos@vacao.com and ask what in the world is causing this unnecessary delay?!

I hear that Theo Stamos received the paperwork on the Degaudio issue yesterday. yahoooooo! As the saying goes "you don't mess around with THEO"! Proximity alone is good enough reason for Roberts and Plowman to have Stamos take this issue into hand. Stamos is a results person you may not always like what gets done but it will be done correctly. @ Satchmo I hope Robin has the hours denoted somehow.
